Selling Illegal Cigarettes

QUESTION:

What is the ruling regarding the sale of illegal cigarettes and the earnings accrued therefrom?

ANSWER:

It is necessary for us as Muslims, to abide by the rules and regulations of the country, particularly when the laws of the country do not contradict the Shariah in any way. Also, if a Muslim is caught selling illegal cigarettes, then this will be a means of humiliation, not only upon the businessman himself, but on the Muslim Ummah at large. It is not permissible to bring humiliation upon the Ummah. Hence, it is not correct for a Muslim to sell items that are considered as illegal in terms of the law.

(افترض عليه إجابته) لأن طاعة الإمام فيما ليس بمعصية فرض فكيف فيما هو طاعة بدائع (قوله: افترض عليه إجابته) والأصل فيه قوله تعالى {وأولي الأمر منكم} [النساء: 59] وقال – صلى الله عليه وسلم – «اسمعوا وأطيعوا ولو أمر عليكم عبد حبشي أجدع» وروي «مجدع» وعن ابن عمر أنه – عليه الصلاة والسلام – قال وإلا لزم بيتهز (الدر المختار و حاشية ابن عابدين 4/264)

Also, consider the following Hadith:

قال رسول الله صلى الله عليه وسلم: “لا ينبغي للمؤمن أن يذل نفسه” قالوا: وكيف يذل نفسه؟ قال: “يتعرض من البلاء لما لا يطيق.” (سنن الترمذي# 2254)

Nabi Sallallahu Alaihi Wasallam said, “It is not appropriate for a believer to humiliate himself.” The Sahabah Radiallahu Anhum asked, ‘How does he humiliate himself?’ Nabi Sallallahu Alaihi Wasallam replied: “He presents himself to such a trial which he cannot bear.”

Furthermore, the money accrued from selling cigarettes will be Makrooh in both instances, be it is legal or illegal cigarettes.

(قوله والتتن إلخ) أقول: قد اضطربت آراء العلماء فيه، فبعضهم قال بكراهته، وبعضهم قال بحرمته، وبعضهم بإباحته، وأفردوه بالتأليف.(الدر المختار 6/459)

والتتن الذي حدث وكان حدوثه بدمشق في سنة خمسة عشر بعد الألف يدعي شاربه أنه لا يسكر وإن سلم له فإنه مفتر وهو حرام لحديث أحمد عن أم سلمة قالت نهى رسول الله صلى الله عليه وسلم عن كل مسكر ومفتر. (الدر المختار و حاشية ابن عابدين 6/460)

وصح بيع غير الخمرمما مر، ومفاده صحة بيع الحشيشة والأفيون.

قلت: وقد سئل ابن نجيم عن بيع الحشيشة هل يجوز؟ فكتب لا يجوز، فيحمل على أن مراده بعدم الجواز عدم الحل.(الدر المختار و حاشية ابن عابدين 6/454)

In conclusion, we advise that one should not deal in illegal cigarettes.
