Selling Milk Without Cream

QUESTION:

A business sells fresh farm milk. Is it permissible for them to boil the milk, remove the cream, and then sell the milk? Or, can they remove the cream with a cream separator and thereafter sell the milk?

ANSWER:

This is permissible on condition that the milk is only sold after extracting the cream. If the milk is sold prior to this, then it will it not be permissible to extract the cream since the sale has been concluded. This will also constitute as deception. Many dairies label the milk as full cream, low-fat, fat-free etc., hence, you should also label accordingly.

البيع: ينعقد بالإيجاب والقبول إذا كانا بلفظ الماضي…وإذا حصل الإيجاب والقبول لزم البيع (مختصر القدوري ص78)

Abu Hurairah Radiallahu Anhu narrates that Rasulullah Salallahu Alaihi Wasallam is reported to have said, “He who takes up arms against us is not from amongst us, and he who deceives us is not from amongst us.”
