QUESTION:
What would be the ruling regarding a Muslim man who consumes wine, and yet slaughters animals in order to provide Halaal meat and poultry to Muslims? What will be the status of that meat or poultry?
ANSWER:
If he slaughters the animal as required in Shariah, then the meat will be Halaal, even though he may a violator of the laws of Shariah. Notwithstanding the above, it is possible that he omits the Tasmiyah intentionally when slaughtering, or deceives the public by purchasing Haraam meat from non-Muslim abattoirs and supplying it to his clients while marketing it as Halaal meat, etc. as such a person is generally bereft of Taqwa. Hence, it is better to exercise caution and refrain from purchasing from such a transgressor. We should purchase our meat from reliable people if we aren’t able to slaughter ourselves. وكون الذابح مسلمًا أو كتابيًا. (الفقه الاسلام وادلته)
الْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ الآية. وقوله: {فَكُلُوا مِمَّا ذُكِرَ اسْمُ اللَّهِ عَلَيْهِ} الآيات، لا اختلاف في حكمهن بين أحد عرف كتاب الله. ولكن الكلام في حكم الذابح هل هو مسلم فيدخل حكمه في حكم الآية؛ إذا ذبح وسمى الله عليها؛ فلو ترك التسمية نسيانا حلت ذبيحته، وكانت من الطيبات، بخلاف من ترك التسمية عمدا فلا تحل ذبيحته. وكذلك أهل الكتاب أعني: اليهود والنصارى، ذبيحتُهم ومناكحتُهم حلالٌ؛ لقوله تعالى {وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ} 3 الآية.
وأما المرتد فلا تحل ذبيحته؛ وإن قال فيها: بسم الله؛ لأن المانع لذلك ارتداده عن دين الإسلام، لا ترك التسمية؛ لأن المرتد شر عند الله من اليهود والنصارى (الجواهر المضية ص43 ج1)
