Talaaq with the words “You are free.”

QUESTION:

There had been so many conflicts in our marriage from the beginning. It settles down and then returns. This time he messaged me saying, don’t call me or message me, but I did, so he said, ” Tum Meri Taraf Se Azaad Ho” i.e: “You’re free from my side”. Does this constitute divorce?

ANSWER:

By using the words “you are free,” the husband will be asked his intention since these are ambiguous words in Talaaq. If he intended Talaaq, then it will be considered Talaaq; otherwise, it will not.

أَنْتِ وَاحِدَةٌ، أَنْتِ حُرَّةٌ، اخْتَارِي أَمْرَك بِيَدِك سَرَّحْتُكِ، فَارَقْتُكِ لَا يَحْتَمِلُ السَّبَّ وَالرَّدَّ، فَفِي حَالَةِ الرِّضَا) أَيْ غَيْرِ الْغَضَبِ وَالْمُذَاكَرَةِ (تَتَوَقَّفُ الْأَقْسَامُ) الثَّلَاثَةُ تَأْثِيرًا (عَلَى نِيَّةٍ) لِلِاحْتِمَالِ وَالْقَوْلُ لَهُ  الدر المختار ص300 ج3)
