Validity of Jumuah on the outskirts of a town

QUESTION:

There is a Masjid 5 kilometres outside Laudium. It is in the industrial area (Sunderland Ridge) on a farm like property, which is directly an offshoot from the R55. It is also around 1,5km away from Eldoglen, which is now a well developed area. I would like to know if it is valid for me to perform Jumuah Salaah there, and how far from the main town will be out of bounds for Jumuah?

ANSWER:

We understand from your query that Sunderland Ridge is on the outskirts of Laudium and Eldoglen, which are developed areas wherein the needs of a person can be easily fulfilled. Also, both Laudium and Eldoglen have a population of more than 3000 people. Now, the question is up to which point is considered as the outskirts of the town? Some of the Fuqaha have considered one ‘Farsakh’, whilst others have considered up to four ‘Farsahk.’ Some jurists have stated that a Shari’ee mile will be considered, whilst others have stated that up to six Shari’ee miles will be considered. A Farsakh is 5.4864 Kilometers, hence four Farsakh (which is the maximum view) will be 21.9456 kilometers. If we have to calculate the distance in miles, one Shari’ee mile is 1.828 kilometers, hence six miles will be 10.968 kilometers. Now, even if we are to take the view of 10.968 kilometers, then too Sunderland Ridge will be considered to be on the outskirts of Laudium and Eldoglen, hence Jumuah will be valid in the area.

However, you should keep in mind that the reward of performing Jumuah Salaah in a Masjid is far superior than performing Jumuah in a Musallah, or on a business premises. Hence, due to convenience one should not lose the reward of performing Salaah in the Masjid. Yes, if by travelling to Laudium for Jumuah and then returning to work, one will be inconvenienced due to traffic congestions during the lunch hour, or employees working for non-Muslim employers are delayed for work, then having Salaah in a Musallah in Sunderland Ridge is quite in order. This is, however, the last resort as explained above.

وَكَمَا يَجُوزُ أَدَاءُ الْجُمُعَةِ فِي الْمِصْرِ يَجُوزُ أَدَاؤُهَا فِي فِنَاءِ الْمِصْرِ وَهُوَ الْمَوْضِعُ الْمُعَدُّ لِمَصَالِحِ الْمِصْرِ مُتَّصِلًا بِالْمِصْرِ (الفتاوي الهندية ص145 ج1)

إقامة الجمعة خارج المصر إذا كان في فناء المصر يجوز فإنه ذكر أبو يوسف أن إماما لو خرج مع أهل المصر مقدار ميل أو ميلين لحاجة لهم فحضرتهم الصلاة جاز له أن يصلي بهم الجمعة قال لأن فناء المصر بمنزلة المصر و هذا لأن فناء المصر ألحق بالمصر فيما كان من حوائج أهل المصرو أداء الجمعة من حوائج أهل المصر(كتاب التجنيس والمزيد 2/193)

وأما الفناء وهو المكان المعد لمصالح البلد كركض الدواب ودفن الموتى وإلقاء التراب، فإن اتصل بالمصر اعتبر مجاوزته وإن انفصل بغلوة أو مزرعة فلا كما يأتي، بخلاف الجمعة فتصح إقامتها في الفناء ولو منفصلا بمزارع لأن الجمعة من مصالح البلد بخلاف السفر كما حققه الشرنبلالي في رسالته(الدر المختار و حاشية ابن عابدين 2/121)

وأما تفسير توابع المصر فقد اختلفوا فيها روي عن أبي يوسف أن المعتبر فيه سماع النداء إن كان موضعا يسمع فيه النداء من المصر فهو من توابع المصر وروى ابن سماعة عن أبي يوسف كل قرية متصلة بربض المصر فهي من توابعه وإن لم تكن متصلة بالربض فليست من توابع المصر، وقال بعضهم: ما كان خارجا عن عمران المصر فليس من توابعه، وقال بعضهم: المعتبر فيه قدر ميل وهو ثلاثة فراسخ، وقال بعضهم: إن كان قدر ميل أو ميلين فهو من توابع المصر وإلا فلا، وبعضهم قدره بستة أميال وعن أبي يوسف أنها تجب في ثلاثة فراسخ، وعن الحسن البصري أنها تجب في أربعة فراسخ، وقال بعضهم: إن أمكنه أن يحضر الجمعة ويبيت بأهله من غير تكلف تجب عليه الجمعة وإلا فلا وهذا حسن.( بدائع الصنائع 1/260)
