Performing Sa’ee before the 2 Rakaats of Waajib-ut-Tawaaf

QUESTION:-

When performing Umrah, if Tawaaf is completed after Fajr, or after Asr, during the time when Salah is not allowed, can the Sa’ee be performed before the 2 Rakaats Waajib-ut-Tawaaf?

ANSWER:-

We haven’t found an explicit ruling in the Kitaabs of Fiqh regarding this Mas’ala. However, the Fuqaha have written that the 2 Rakaats of Waajib-ut-Tawaaf should be performed immediately after Tawaaf in accordance with the Sunnah, and delaying the two Rakaats (without a valid reason) will be considered as Makrooh. However, if the Tawaaf was performed after the Fajr or Asr Salaah, then delaying the 2 Rakaats of Waajib-ut-Tawaaf to a later time will be permitted, as performance of Salaah after the Asr and Fajr Salaah is Makrooh. In this instance, it will be acceptable to perform the Sa’ee first, and then perform the two Rakaats Waajib-ut-Tawaaf.

Furthermore, the Fuqaha have mentioned that these 2 Rakaats of Waajib-ut-Tawaaf is not restricted to any time or place, to such an extent that if one reads it out of the Haram, or even after returning to his hometown, it will be fulfilled; although doing so is considered as Makrooh. Hence, this too indicates that if the Sa’ee is performed first, then the 2 Rakaats of Waajib-ut-Tawaaf will be discharged.

وأما صلاة ركعتي الطواف بعد كل أسبوع فواجبة على الصحيح ..

 قوله فواجبة على الصحيح أي بعد كل طواف فرضا كان أو واجبا أو سنة أو نفلا ولا يختص جوازها بزمان ولا بمكان ولا تفوت ولو تركها لم تجبر بدم ولو صلاها خارج الحرم ولو بعد الرجوع إلى وطنه جاز، ويكره والسنة الموالاة بينها وبين الطواف .ويكره تأخيرها عن الطواف إلا في وقت مكروه أي؛ لأن الموالاة سنة (البحر الرائق شرح كنز الدقائق 2/356)

 والجمع بين اسبوعين فاكثر من غير صلاة بينهما الا في وقت كراهة الصلاة لانه لا كراهة حينئذ بالجمع شفعا و وترا لكن يؤخر ركعتي الطواف الى وقت مباح (مناسك ملا علي القاري 165)
