Using children’s money without consent

QUESTION:

Are parents permitted to use the money of their Baaligh/adult children, without the consent of the children? And are they allowed to do so without the consent of the children when the money will be used for the children?

ANSWER:

The parents should take the consent of their Baaligh children before using their funds even though the funds may be spent on them. However, Imaam Tirmidhi Rahimahullah has written that the father has a “wide hand”, in the sense that he may take whatever he wishes from the wealth of his children (for himself). Other commentators have stated that this ruling is only applicable when the father is in need.

Kitaab-un-Nawaazil states that those things that are generally taken without having to seek permission and no one really objects to it, the father too is at liberty to take such things from the son without seeking permission. [Re:- Kitaab-un-Nawaazil Pg.118 Vol.15]

       عَنْ عَائِشَةَ قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ أَطْيَبَ مَا أَكَلْتُمْ مِنْ كَسْبِكُمْ، وَإِنَّ أَوْلَادَكُمْ مِنْ كَسْبِكُمْ» وَفِي البَابِ عَنْ جَابِرٍ، وَعَبْدِ اللَّهِ بْنِ عَمْرٍو: هَذَا حَدِيثٌ حَسَنٌ وَقَدْ رَوَى بَعْضُهُمْ هَذَا عَنْ عُمَارَةَ بْنِ عُمَيْرٍ، عَنْ أُمِّهِ، عَنْ عَائِشَةَ وَأَكْثَرُهُمْ قَالُوا: عَنْ عَمَّتِهِ عَنْ عَائِشَةَ وَالعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ العِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ قَالُوا: إِنَّ يَدَ الوَالِدِ مَبْسُوطَةٌ فِي مَالِ وَلَدِهِ يَأْخُذُ مَا شَاءَ، وَقَالَ بَعْضُهُمْ: لَا يَأْخُذُ مِنْ مَالِهِ إِلَّا عِنْدَ الحَاجَةِ إِلَيْهِ (سنن الترمذي – باب ما جاء ان الوالد يأخذ من مال ولده)

 وَلا عَلى أَنْفُسِكُمْ أَنْ تَأْكُلُوا مِنْ بُيُوتِكُمْ اى البيوت الّتي فيها أزواجكم وعيالكم ودخل فيها بيوت الأولاد لان بيت الولد كبيته حيث قال رسول الله صلى الله عليه وسلم أنت ومالك لابيك- أخرجه الستة وابن حبان والحاكم عن عائشة وقال رسول الله صلى الله عليه وسلم ان أطيب ما يأكل الرجل من كسبه وان ولده من كسبه- رواه ابو داود والدارمي من حديث عائشة وروى الترمذي والنسائي وابن ماجة نحوه والمعنى ليس عليكم حرج ان تأكلوا من اموال أزواجكم وأولادكم (التفسير المظهري ص560 ج6)
