QUESTION:
If a woman gets her Haidh while in Ihraam on the way to Makkah before performing Umrah, even though she was taking tablets to delay her Haidh, and her cycle will only end once she is back in South Africa, what is the way forward if she cannot take any tablets to stop her Haidh as she is also breastfeeding and most tablets will stop her milk production as well?
ANSWER:
If a female in Ihraam does not become Paak from Haidh despite using the tablets, then she will be required to delay her flight until she becomes Paak and completes her Umrah. Only then should she return home otherwise she will remain in a state of Ihraam even after returning home.
However, if she performed her Umrah in a state of Haidh and became Halaal in Makkah Sharif, then a goat will be obligatory as Damm. Her Umrah will be valid with deficiency and will not have to be repeated. [Re:- Fataawa Qaasmiyyah Pg.417 Vol.12] Some scholars have permitted women to act on this ruling due to these circtumstances. قَالَ فِي اللُّبَابِ اعْلَمْ أَنَّ الْمُحْرِمَ إذَا نَوَى رَفْضَ الْإِحْرَامِ فَجَعَلَ يَصْنَعُ مَا يَصْنَعُهُ الْحَلَالُ مِنْ لُبْسِ الثِّيَابِ وَالتَّطَيُّبِ وَالْحَلْقِ وَالْجِمَاعِ، وَقَتْلِ الصَّيْدِ فَإِنَّهُ لَا يَخْرُجُ بِذَلِكَ مِنْ الْإِحْرَامِ، وَعَلَيْهِ أَنْ يَعُودَ كَمَا كَانَ مُحْرِمًا وَيَجِبُ دَمٌ وَاحِدٌ لِجَمِيعِ مَا ارْتَكَبَ، وَلَوْ كُلَّ الْمَحْظُورَاتِ (البحر الرائق ص17 ج3)
إذا طاف للصدر جنبا أو محدثا، فما دام بمكة يعيده، وإن رجع إلى أهله، فعلى الجنب الشاة (المحيط البرهاني ص464 ج2)
