QUESTION:
A person is unable to carry out his own Rami due to health reasons and wishes to appoint another person to do Rami on his behalf. Is it necessary for his representative to be performing Hajj as well?
ANSWER:
The Kitaabs of Fiqh state that one who intends doing Rami on behalf of another (due to a valid Shari’ee reason such as severe illness), then he should first complete his own Rami and then carry out the Rami of the other person. This in essence means that the one doing Rami on behalf of someone else, should be one who is performing Hajj as well.
ولو رمى بحصاتين إحداهما عن نفسه والأخرى من غيره جاز ويُكره (لباب) ، والأولى أن السبعة أولا عن نفسه ثم عن غيره (شرح) ، لكن الظاهر أنه في يوم النحر ، وأما في الأيام الثلاثة فالأولى أن يرمي الجمار الثلاثَ عن نفسه أولا ثم عن غيره؛ لئلا تفوته الموالاة، فالأولى إسقاط قوله: «السبعةَ»، كما فعله في (المنحة) وقوله : في اللباب بحصاتين أي واحدةً بعد واحدة لا جملةً. والله سبحانه وتعالى أعلم.(غنية الناسك ص300)
